Farmer fined after worker becomes entangled in potato harvester

It has been reported by the Health and Safety Executive (HSE)* that on 21 August 2020, at Folkestone Magistrates Court, a farmer was sentenced after a worker suffered multiple injuries after becoming entangled in the contra-rotating rollers of a potato harvester.

The worker was pulled leg first into the machine resulting in burns to his leg, a pulled hamstring, torn calf, broken nerves and a hairline fracture to the knee and ankle.

An investigation by Health and Safety Executive (HSE) found that the Alan Down from Kent had failed to implement a “safe stop procedure “ to isolate power and stop the movement of the rollers before the worker accessed them. Mr Down pleaded guilty to breaching Regulation 11(1)(b) of the Provision and Use of Work Equipment Regulations 1998 and was fined £4,992 and ordered to pay costs of £5,805.

The farm worker will be entitled to claim compensation as well as access to help and rehabilitation for his injuries.

Compensation will not just be limited to money for injuries but should include loss of earnings, pension loss, physiotherapy and/or any other rehabilitation, as well as and aids and appliances that he may need to help him recover.
